Naming rules in terms of service

I’m curious about naming rules. I came across someone who was using the name Conan for a character name. I warned the player there may be rules against such a name since all the online games I’ve played in the past had rules against names of commonly known IPs especially if it dealt with the game they were playing. I’ve read thru the terms of service and I don’t see any rules dealing with that issue. Was I wrong to warn the player for using Conan as a character name?

No. If there is an expletive than that is something else to deal with.

It’s odd, really. I’d wager that wouldn’t be an issue in this case, odd choice though it may be. A lot of names simply can’t be made due to the filter that catches words like assassin, nudity, and the more profane actual cuss-words of course. Would be nice to have a full list of these words, it kind of sucks typing up a long note on xbox only to have it tell you when trying to save that you used a word you are not allowed to and deleting whatever you typed up. It’s a bit arbitrary, abovementioned words are a no-go but you are allowed to type out, say, defecate for example.

That’s a definitive answer but with no reasoning. I would like something a little more concrete especially given this line at the beginning: “Please read through and consider the spirit of the rules, not just the specific wording.” And also this line: “We reserve the right to modify these rules in any way we deem necessary and at any moment, at our own discretion.”

Personally I would not want to use such a name based on that line alone since such rules are so common in other games. I figure it’s only a matter of time before they will be applied to Conan Exiles as well. Then there’s the “spirit” of the rules which could mean whatever they want it to mean. I think it could be argued that a name like Conan may not be against the letter of the terms of service but could be argued to be against the spirit of the terms of service.

If someone used your name (either your gamer name or RL name) would you attempt to sue them for defamation or identity theft?

If the answer is no, you have your answer. If the answer is yes, then I feel sorry for you.

I’m not a company and my name is not a copyrighted intellectual property so I think your argument doesn’t apply. Also intent plays a part in your question since if they just happen to share a name then no big deal but if they’re trying to steal your identity, which is a thing both in real life and online then that’s a problem. It’s one thing to use the same name and it’s quite another to use the name with the intent of stealing an account or similar action.

The question you asked was a yes or no question, not open-ended. Friend, why are you so worried about another person using the name “Conan”? If it’s not you, then do not worry about it. I’ve seen plenty of characters named Red Sonja, Solome, Akivasha, Kull The Conqueror, Akiro the Wizard, and Thulsa Doom- I could go on and on about character names from IP’s that are not Conan or Howard-related as well. Funcom clearly does not have a policy against it. You seem to be oddly lawyering the TOS to find some reason to (potentially) report this innocent player and have come here to receive a confirmation of your intention. My answer- relax, and let it go.

I’m concerned about it because afterward I had several people jump on my case about it. Some claiming I was making demands when I was not. I saw an issue that could cause someone headaches they might rather avoid and warned them of the possibility. I’ve seen it before in other games and since they were low level I suggested they might want to start again and change the name just in case.

That and now I genuinely want to know what Funcoms stance on the issue is. Since they haven’t answered as yet I’m arguing the case more to keep the thread alive than anything else in hopes of getting Funcoms input. Then if the issue ever arises again I’ll know for certain one way or another.

Yes, because you came across as extremely hyper-focused on a non-issue and I don’t like to throw this term about but, you probably sounded a bit like a Hall Monitor. That is why people jumped on you, they expressed that you were overstepping; not only on the enforcing of the TOS, but socially in the server culture acting as a - well- the Sheriff of Nottingham. The problem is that you have no ground to stand on with your “warning of a player” because as you even stated here on this thread in your original Post:

Friend, there is no such rule, and you’ve already stated you’ve looked it up and found no such ground. to stand on in continuing this non-issue.

If your concern is that other players on the server would somehow confuse this person for the “In Game Conan” then, you were mistaken. I think you overthought the situation and underestimated the intelligence of your fellow playmates.

If we are lucky an admin might respond to this thread. However, I do not think you’ll be satisfied with the admin’s response should we be blessed to receive one.

Ah, Hello Vin. Given how you’ve behaved both in this affair long after I stopped talking in the server about it and regarding other issues in the past excuse me if I don’t accept your input. I expect you’re right they will say it’s not against the terms of service but I like knowing for sure. Maybe you’re right and I came across like a hall monitor but I’d rather make a mistake in trying to help someone than not help at all, or worse just act like a general jackass.

It’s a shame you’ve confused me with a player on your server and that is why you’ve disregarded my input. If the person you’re thinking of acts and speaks as I do in the server global chat, then perhaps the server isn’t a bad place to play on with rational individuals online.

Ah Vin sometimes starts out as rational but he rarely ends that way. Funny it always ends in insults and tirades. He leaves rationality behind in favor of shall we say incivility. If that’s what you want to identify with then be my guest.

Xbox is a key word here. Funcom does not have a word filter, Xbox does.

Also, even though I’m not a lawyer, very much doubt that the copyright and intellectual property laws cover the naming of a player’s videogame character, per se. And even if they did, there’s always the fair use doctrine to account for.

That’s because such a rule quite clearly doesn’t exist. There are rules about building abuse, there are rules about hacks and exploits, there are rules about harassment and inappropriate content, but there are no rules telling me that I can’t name my character “Luke Skywalker”.

Do you think the person using Conans name was attempting to steal or defame him? I highly doubt it. Its a person playing a game, ,most likely with a male toon that they made look like Conan, and called them that.

Would this apply to anything relating to the Conan universe?
