Not really. A slippery slope? Perhaps. Though the POI rules only state the blocking of a POI, not the building of something in the area. The Sinkhole doesn’t just get blocked by an elevator placement, nor does the elevator block the spawn of the dragon. Were something to block the spawn or the ability to discover the region, then yes, absolutely it would be against the TOS. Though that doesn’t negate the fact that sure, it does ruin the immersion factor of the boss fight to see an elevator in the background. That being said, most people see it as a convenience, so they’re unlikely to say much about it. That’s usually the difference between whether something is in violation or not since Funcom won’t browse servers of their own accord. One could argue that a massive build there MIGHT be in violation, but a simple elevator isn’t, according to their own rules.

Ya building on a POI is definitely not a violation.
As @jmk1999 clarified, it is the blocking or despawning of POIs and spawns that are violations.

I’ve built that elevator before. It’s a convenience. But to me it is one of those things that dances on the edge of the TOS. So I’d not report it. Some else might.
And you know I never dance on the edge of a TOS 
Yeah, it’s definitely in the gray area, but as I’ve mentioned, they don’t consider it a violation. By your initial definition to not build at a POI, that would prevent a lot of cool locations to be built at (i.e. The Crevice in the tundra area). So long as someone doesn’t block the POI discovery, all should be good. That doesn’t mean they can’t change that rule though. Would be a total bummer if they did.

If you’re careful, you can climb down into that pit and avoid the snakes, skeletons and corruption. But you have to be mindful of where you’re climbing down and make yourself hard to spot by those archers. It’s a really, very nasty and often fatal fall if you make a misstep or get hit by an archer at the wrong time while going down.
You can simply circumvent the bone dragon, just dealing with the skeletons unless you need to get the Star of the Champion.
I won’t bother going down into that pit until I hit level 55.

If you need horizontal elevators; Ltrains, to get from one end of your base to the other…

Elevators are used a lot for PVP bases for strategic reasons.
