which is annoying as hell. even if im holding a pick axe i still wanna be able to put it away. why arent i allowed to do that?

I agree, this is annoying. However - I imagine that this is built in this way to prevent looters from taking the item out of your hand while your body is loaded in the world, and you are offline. I cannot think of another reason why they would lock the in-hand item that way.
If you drag something out of your bar, it should be clear that you want it out of your hand also. Might be a system limitation with other interfacing (other players versus you).
