Deep Breath did not work on login (1st perk of Vitality)

Upon login and farming underwater, Deep Breath did not activate. I did notice the fact, but my inevitable drowning resolved it.

This has happened twice, but not all the times I have logged in since the patch (15 times?).

For any that read this and have it happen, die close to your spawn point. Until we have some notice of correction, I plan to do that upon login since I often farm brimstone, gold and silver underwater.
